Since President Trump was inaugurated last Monday, there have been a number of national news stories about parents and teachers’ worries about potential ICE (Immigration & Customs Enforcement) raids at schools. This afternoon, the Superintendent of NSBORO schools issued a message about the situation to parents and caregivers.
The text and email seeks to reassure parents by clarifying students’ rights and the schools’ responsibilities.
The message explains that schools are required to provide students an education regardless of their immigration status, and personnel are committed to making all students and staff feel “a true sense of belonging”.
It also specifies that staff is legally prohibited from asking about students’ immigration status, required to protect their privacy, and can’t allow ICE or authorities into their properties unless they have a warrant.
Here is the message from Northborough-Southborough Public Schools Superintendent Gregory Martineau:
Over the past week you have likely seen news about changes in federal policies regarding enforcement of immigration laws, including a change in the Department of Homeland Security’s policy regarding conducting enforcement actions in schools. I want to articulate The Public Schools of Northborough and Southborough’s (NSboro) legal obligations related to student rights.
First, I want to reaffirm the District’s commitment to its core values: Equity, Empathy, Respect, Responsibility, Inclusivity, and Creativity. These values guide daily interactions and decisions, ensuring every student and staff member feels a true sense of belonging. Additionally, the District’s mission to Educate, Inspire, and Challenge ALL students is grounded in its commitment to providing a safe and supportive environment where ALL can thrive.
The Public Schools of Northborough and Southborough is legally obligated to adhere to The U.S. Supreme Court’s ruling in Plyer v. Doe (1982). This ruling ensures that children cannot be denied a free public education based on their immigration status. I want to highlight that the District strictly complies with all local, state, and federal laws, including:
The Family Educational Rights and Privacy Act (FERPA), that protects the confidentiality of student and family information.
Massachusetts state laws safeguarding student privacy and educational rights.
Not asking students or families about immigration status.
Not sharing student records without appropriate legal documentation.
